Recommendations
for reforming state’s
death penalty system
Saying, “When a life is at stake, there is no room for error or injustice,” the American Bar Association and the Florida Death Penalty Assessment Team have recommended reforming Florida’s death penalty in ways including the following:
1. Ensuring that all inmates sentenced to death receive properly qualified lawyers. Currently, registry lawyers with minimal trial or appellate experience are allowed to be death penalty lawyers;
2. Requiring juries to make the ultimate sentencing decisions. Currently, judges can overrule jury’s sentencing recommendations, something that could decrease juries’ sense of responsibility, causing them to deliberate less and pay less attention to instructions;
3. Ensuring an open, transparent clemency process. Currently, the Board of Executive Clemency is not required to hold public hearings on inmates’ claims or to provide reasons for clemency denial.
